Scope of application

The following general terms and conditions apply to all deliveries, contracts and other services from us, Sakiba fair Design eU | Mag. Susanne Schaub, hereinafter referred to as sakiba, to the end consumer; and regulate the use of our website and the purchase of goods via our online shop.

Our online offer is aimed exclusively at end customers. End customer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

The terms and conditions always apply in the version valid at the time of the order and should be read carefully before using our web shop.

By using our online shop or placing an order through it, you agree to our general terms and conditions. Should a provision of the GTC be wholly or partially ineffective, the remaining provisions shall remain unaffected.

There are no verbal agreements. Changes or additions to the contract must be made in writing and must be confirmed by us in writing in order to be legally valid.

The legally binding version of these terms and conditions is the German edition. If there are contradictions or errors from the translation in foreign language editions, the German version applies in case of doubt.

The following conditions also apply exclusively to all transactions carried out abroad.

The presentation of goods in the webshop does not constitute a binding application for the conclusion of a purchase contract. Rather, it is a non-binding invitation to order.

By clicking the button “….” In the last step of the ordering process, you are making a binding offer to purchase the goods in the shopping cart. When placing an order by phone, you are also making a binding offer by placing the verbal order.

You can only order online if all mandatory fields – fields marked with an asterisk – have been filled out. Before submitting the order, you will receive a list of the content of the order (including prices), which you can change before confirmation.

After receipt of the purchase offer, you will receive an automatically generated email confirming that we have received the order (confirmation of receipt). This confirmation of receipt does not yet represent an acceptance of the purchase offer. A contract is not yet concluded with the confirmation of receipt.

Sakiba is entitled, but not obliged, to accept your contract offer within 14 calendar days of receipt of the offer by Sakiba. If your offer is not accepted within 14 calendar days, it is considered rejected.

The contract is only concluded when a written confirmation of acceptance of the offer is sent by email and at the latest when the goods are delivered.

Prices and shipping costs

The prices stated in the webshop at the time of ordering apply. The currency is EUR. All prices quoted in the Sakiba webshop include the applicable VAT. The prices do not include delivery costs and ancillary services.

Deliveries within Austria: From an order value of 150.00 EUR, we send deliveries within Austria free of charge. If the order value is less than 150.00 EUR, we charge a flat shipping fee for the delivery.

Deliveries to EU countries and Switzerland: From an order value of 150.00 EUR, we send the delivery free of charge. If the order value is less than 150.00 EUR, we charge a flat shipping fee for the delivery.

Other costs: If export or import taxes are incurred as a result of the shipment, these will be borne by the customer. The prices indicated by Sakiba for the deliveries offered do not include costs that are charged by third parties.

Delivery and availability of goods

Deliveries are only possible to delivery addresses within the EU (Austria, Germany, Belgium, Czech Republic, Luxembourg, the Netherlands, Hungary, Slovenia, Slovakia, France, Italy, Poland and Sweden), Great Britain and Switzerland.

Delivery will be made to the address given by the customer. In the event of incorrect, incomplete or unclear information provided by the customer, the customer shall bear all costs arising therefrom.

Sakiba sends the goods within 3-8 working days from receipt of the complete and error-free order.

Should we not be able to accept an order or only partially due to the unavailability of the goods, we will inform you immediately. A contract for goods that cannot be delivered is not concluded.

If partial deliveries are necessary, these are permitted and can be invoiced separately as a separate transaction.

The risk of accidental loss and accidental deterioration of the sold item is only transferred to the buyer when the item is handed over to the buyer, even in the case of sale by mail.

If the delivery is impaired by force majeure, strikes, unforeseeable obstacles or other circumstances for which we are not responsible, the delivery time will be extended appropriately. We will inform you about this.

Terms of payment

You have the option of either making a direct deposit, using a credit card (Mastercard, Visa) or PayPal.

As soon as we can freely dispose of the amount, the payment is deemed to have been made.

Please note that discount and voucher codes cannot be considered and credited retrospectively. Discount and coupon codes and their value cannot be withdrawn.

Right of withdrawal and consequences of withdrawal:

You have the right to cancel the concluded contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. In order to exercise the right of withdrawal, you must inform us (Sakiba fair Design eU | Mag. Susanne Schaub, Zaunergasse 12/1/4, 1030 Vienna, Mail: sg@sakiba.com) by means of a clear declaration (e.g. by post sent letter or e-mail) of your decision to withdraw from the contract. To meet the withdrawal deadline, it is sufficient for you to send the notification that you are exercising your right of withdrawal before the withdrawal period has expired.

If you revoke your contractual declaration, we have to repay all payments that we have received from you, including delivery costs, immediately and at the latest within fourteen days from the date on which we received notification of your withdrawal. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment.

We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.

You are obliged to send the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the withdrawal from the contract (Sakiba fair Design eU | Mag.Susanne Schaub, Zaunergasse 12/1/4, 1030 Vienna) to be returned or handed over. The deadline is met if you send the goods before the period of fourteen days has expired.

The customer bears the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling that is not necessary to check the nature, properties and functionality of the goods.

Title retention

The delivered goods remain our property until the purchase price has been paid in full.

Warranty

The statutory warranty provisions apply, unless otherwise stipulated below.

The color names given in the webshop are not based on standards. Based on this information, it is only possible to draw conclusions about generally applicable color concepts to a limited extent and do not constitute grounds for complaint.

For technical reasons, the actual colors may differ slightly from the colors shown in the web shop. Other minor deviations in the dimensions of the delivered goods from the product offers in the Sakiba web shop are also permitted and do not constitute defects.

Obvious defects in the delivered goods as well as shortages or incorrect deliveries can only be asserted if you inform Sakiba in writing within 10 working days of delivery with a precise description. The time at which the complaint is sent is decisive.

Liability

The right to compensation is limited to intent or gross negligence.

The exclusion of liability does not apply to injury to life, limb or health and to breach of essential contractual obligations. In the latter case, liability is limited to typical, foreseeable damage.

Liability under the Product Liability Act and other mandatory statutory provisions remains unaffected.

Copyrights

Our products, images, designs, logos and motifs that we sell and / or use are protected by copyright. Use, publication and duplication is only permitted with our express written consent.

Data protection / data processing

Personal data such as name, address, email address are stored by us with computer support for the purpose of order processing, but are never passed on to third parties. You can view the detailed data protection declaration at any time under the menu item Privacy policy.

Final provision

The business relationships between Sakiba and the customer are subject to the law of the Republic of Austria; the UN sales law is excluded.

TERMS OF SALES AND DELIVERY OF SAKIBA FAIR DESIGN eU.

The following general terms and conditions regulate the contractual relationship between Sakiba Fair Design e.U. and entrepreneurs who buy goods through our shop.

1.) Conclusion of contract

1.1 A contract with Sakiba Fair Design eU is only concluded when we issue our written order confirmation or through delivery. Our order confirmation is decisive for the content of the contract, in particular for the scope of services.

Our deliveries are made, without exception, under the conditions set out here. Subsidiary agreements are only legally binding if they are confirmed by us in writing.

1.2 Color deviations between goods and images in the online shop, catalog and brochures are possible for technical reasons.

2.) Prices

The prices are in euros for delivery from Vienna, with a minimum order value of 150 euros, including postage and packaging, plus applicable VAT for Austria.

The stated RRPs are minimum sales prices.

3.) Order acceptance

If orders are accepted by representatives, we reserve the right to accept the order. This also applies to parts of the order with incorrect prices or quantities.

4.) Delivery

If possible, delivery will take place within the agreed time frame. Partial deliveries are permitted. If the delivery time is exceeded, we are entitled to deliver the goods within a reasonable period of time.

In the event of force majeure, we may withdraw from the delivery in whole or in part. Claims for damages due to late or non-delivery are excluded in any case.

There is a minimum order value of €150.

5.) Shipment

Regular shipping is covered by our transport insurance. For a special form of shipping requested by the customer, for example express, quick parcels, courier, etc., the additional costs are at the customer's expense.

6.) Payment

If our claim is pursued, all associated costs will be borne by the debtor.

7.) Retention of title

The goods remain our property until all of our claims have been paid in full. The buyer must inform us immediately of any seizure or any other impairment of our rights by third parties.

8.) Complaints

Complaints can only be made in writing within 8 days of receipt of the goods.

9.) Deviations

Deviations in weights, colors and dimensions that arise despite careful production of the goods do not give rise to complaints.

10.) Property and copyrights

The patterns, images, etc. we use are our own developments. We reserve all property rights and copyrights. Forwarding to third parties requires our written consent

11.) Customer data

We are entitled to store and process all data relating to the customer within the framework of the relevant legal regulations.

12.) Place of payment and place of jurisdiction

The place of fulfillment for all obligations of both parties to the contract is Vienna.

The law of the Republic of Austria applies exclusively to all legal relationships between buyer and seller.
